Abstract [It]:Il contributo rilegge il concetto di Daseinsvorsorge, teorizzato da Forsthoff, nell’odierno ecosistema digitale, analizzando come le infrastrutture tecnologiche essenziali siano ormai controllate da poteri privati transnazionali. Questa asimmetria genera una ‘sovranità dimidiata’ per gli Stati europei, costretti a dipendere da attori esterni per la garanzia dei propri servizi essenziali. Attraverso il caso studio del progetto Gaia-X, il saggio evidenzia inoltre i limiti strutturali e le contraddizioni dei tentativi europei di riconquistare l’autonomia strategica e infrastrutturale, sollevando un problema di controllo democratico e costituzionale che va oltre la mera tutela della concorrenza.
Abstract [En]:This paper revisits Forsthoff’s concept of Daseinsvorsorge within today’s digital ecosystem, analyzing how essential technological infrastructures are currently controlled by transnational private powers. This asymmetry generates a ‘diminished sovereignty’ for European States, which are forced to depend on external actors to guarantee their own essential services. Through the case study of the Gaia-X project, the essay highlights the structural limitations and contradictions of European attempts to regain strategic and infrastructural autonomy, raising an issue of democratic and constitutional oversight that goes beyond mere antitrust regulation.
