Abstract [It]: L’A. ripropone una lettura minoritaria dell’art. 28 della Costituzione repubblicana che oggi sembra rispondere meglio di quella tradizionale alle esigenze della democrazia contemporanea alla luce delle modifiche al testo originario della Carta intervenute medio tempore. In particolare, il microsistema che ruota attorno all’art. 28 Cost. reinterpretato viene utilizzato per valutare le ipotesi di riforma della giustizia contabile attualmente in discussione al Senato.
Abstract [En]: This article examines the legal status and protection of the Irish language on the island of Ireland. Drawing on the historical role of Irish as both an element of nation-building and a marker of collective identity, the analysis traces the distinct legal trajectories developed in the two jurisdictions. In the Republic of Ireland, the focus is on the constitutional recognition of Irish, its legislative implementation, the role of the courts in shaping the scope of linguistic obligations and issues relating to legislative procedure and drafting. In Northern Ireland, language protection is instead framed within a model grounded in political agreements and supranational sources, culminating in the New Decade, New Approach agreement and the Identity and Language Act 2022. The article concludes with a critical assessment of the effectiveness of the instruments examined, highlighting the enduring gap between formal recognition and the practical use of the language.
